RENTAL AGREEMENT

                                RECEIPT IS HEREBY ACKNOWLEDGED by Erskine G. Donald, hereinafter called Owner, from,______________________________hereinafter called Tenant,______________________________the sum of                                                                                         ($_________________.00) for  rent of the condominium Doral Unit D-1006 owned by said Owner and located at 5 BeachClub Trail, Gulf Shores, Alabama in Baldwin County, Alabama which unit the Owner hereby agrees to rent to said Tenant at a rental rate of $______________.00 per                         , plus a $100 cleaning fee, the total equal to the above rental amount. A 15% deposit ($_________.00) is payable in advance by separate check to secure said lease for the following time period:

*If you arrive before the noted check in time, the unit may not be cleaned and ready since our cleaning service on occasion must prepare the unit between the times noted on the same day.

 

                                IN CONSIDERATION HEREOF, and of the use or occupancy of the said premises, the Tenant agrees:

 

                1.  To maintain said premises in a clean, orderly and law-abiding manner.  The Owner shall have the right to inspect said premises at any and all reasonable times.

 

                2.  Agree not to allow smoking by anyone while in said unit.

 

                3.  To pay for any damage done to said premises, and the cost of any cleaning up damaged areas of said premises which Owner may consider necessary.  Deposit will be refunded in full (deposit check returned) if there are no damages as described herein.

 

                4.  Not to let or sublet the whole or any part of the premises to anyone for any purpose whatsoever.

 

                5.  To maintain the unit in the same condition as it is now in, reasonable wear and tear and damage by the elements excepted, and subject to cleaning by the Owner following the rental term. The deposit described above shall be refunded in full (deposit check returned) upon satisfactory inspection of the unit following this rental term.

 

                6. The Owner shall not be liable for any injury or damage to any person or to any property at any time on said premises or condominium unit from any cause whatever which may arise from the use or conditions of said premises or unit.  

 

                7. That the violation of any of the covenants of this agreement or the non-payment of any rent when due and unpaid shall be sufficient cause for eviction from said premises and that if suit be brought, to collect rent or damages or to cause eviction from said premises, or to collect the costs of repairs to or cleaning of said premises.  Tenant agrees to pay all costs of such action, including reasonable attorney's fees as may be fixed by the Court.

                                                                                                                                 

                8.All applicable rent shall be paid directly to Erskine G. Donald, 4212 County Road 59, Pine Apple, AL 36768.

 

Each party hereto acknowledges receipt of a copy of this agreement.
